Chapter 65

א דאביק בה מהדר הדר אזיל
1 he has already become attached to it he will go again and again
ב והתניא ישראל ההולך לתרפות בין בהליכה בין בחזרה אסור אמר רב אשי כי תניא ההיא בישראל מומר דודאי אזיל
2 But has it not been taught: It is forbidden [to do any business transactions] with an Israelite going towards a place of idolatry either on his journey there or back? R. Ashi said: When they taught that, it referred to an apostate Israelite, who is sure to go.
ג ת"ר עובד כוכבים ההולך ליריד בין בהליכה בין בחזרה מותר ישראל ההולך ליריד בהליכה מותר בחזרה אסור
3 Our rabbis taught: With an idolater going to a market-fair it is permitted to deal both on his journey there and back; but in the case of a Jew going to such a fair, it is permitted on his journey there but forbidden on his return journey.
ד מאי שנא ישראל דבחזרה אסור דאמרי עבודת כוכבים זבין דמי עבודת כוכבים איכא בהדיה עובד כוכבים נמי נימא עבודת כוכבים זבין דמי עבודת כוכבים איכא בהדיה
4 Why is an Israelite different in that it is forbidden on his return journey? For we say that he may have been selling articles of idolatry and has thus idolatry money with him. Should we not say the same in the case of an idolater that he may have sold articles of idol-worship and carries idolatry-money on him?
ה אלא עובד כוכבים אמרינן גלימא זבין חמרא זבין ישראל נמי נימא אימור גלימא זבין חמרא זבין אי איתא דה"ל הכא הוה מזבין ליה:
5 Rather, in the case of an idolater we say that he may have sold such things as a garment or wine. [If so] let us then say in the case of an Israelite, too, that it may have been such things as a garment or wine that he was selling! If he had such things only he would have sold them here.
ו והבאין מותרין: ארשב"ל לא שנו אלא שאין קשורין זה בזה אבל קשורין זה בזה אסורין אימא דעתו לחזור:
6 But with those coming from there it is permitted. R. Shimon b. Lakish said: This teaching applies only if they are not connected to one another, but if they are connected to one another it is forbidden, for we should say that each one has a mind to return again.
ז נודות העובדי כוכבים וקנקניהם: ת"ר נודות העובדי כוכבים גרודים חדשים מותרין ישנים ומזופפין אסורין עובד כוכבים ריבבן ועיבדן ונתן לתוכן יין וישראל עומד על גביו אינו חושש
7 Skin bottles and [earthenware] flagons belonging to pagans. Our Rabbis taught: Skin bottles of pagans, without pitch: If they are new, they are permitted. But if old or lined with pitch they are forbidden. If a pagan lined them with pitch and put the wine into them while an Israelite was standing by him, there is no reason for concern.
ח וכי מאחר דעובד כוכבים נותן לתוכן יין כי ישראל עומד [על] גביו מאי הוי אמר רב פפא ה"ק עובד כוכבים ריבבן ועיבדן וישראל נותן לתוכן יין וישראל אחר עומד על גביו ואינו חושש
8 But since the pagan puts the wine into the bottles, how does it help that an Israelite stands by him? R. Papa said: What is meant is that if a pagan pitched and lined them and an Israelite poured wine into them while another Israelite was standing by there is no cause for suspicion.
ט ומאחר דישראל נותן לתוכן יין ישראל אחר עומד על גביו למה לי דלמא אגב טירדיה מנסך ולאו אדעתיה
9 But if it is an Israelite that is pouring the wine into them, what need is there for another Israelite to stand by? Lest while the Israelite is busy, the heathen pour some of it out for idolatry and he wouldn’t notice.
י רב זביד אמר לעולם כדקאמרת מעיקרא והכא בעידנא דקא שדי ליה נעשה כזורק מים לטיט אמר רב פפי ש"מ מדרב זביד האי עובד כוכבים דשדא חמרא לבי מילחי דישראל שרי
10 R. Zevid said: The original wording can indeed stand, but here the reason is that when wine is poured into the fresh pitch it is as water that is poured in mortar. R. Papi said: From what was said by R. Zevid it may be deduced that if a pagan poured wine into the salt cellar of an Israelite [the salt] is permitted.
יא מתקיף לה רב אשי מי דמי התם קאזיל לאיבוד הכא לא קאזיל לאיבוד
11 R. Ashi raised a difficulty: How can these be compared? In that case the wine has disappeared, while here it has not disappeared!
יב בר עדי טייעא אנס הנהו זיקי מרב יצחק בר יוסף רמא בהו חמרא ואהדרינהו ניהליה אתא שאיל בי מדרשא א"ל רבי ירמיה כך הורה רבי אמי הלכה למעשה ממלאן מים שלשה ימים ומערן ואמר רבא צריך לערן מעת לעת
12 Bar Adi, an Arab, once seized a wine-skin from R. Isaac b. Joseph. He put wine in it returned it to him. He came and asked about it in the Bet Midrash. R. Yirmiyah said to him: This is how R. Ammi ruled in an actual case: [The vessels] are to be filled with water for three days and then emptied. And Rava said: The water should be emptied every twenty-four hours.
יג סבור מינה הני מילי דידן אבל דידהו לא כי אתא רבין א"ר שמעון בן לקיש אחד שלנו ואחד שלהם סבר רב אחא בריה דרבא קמיה דרב אשי למימר הני מילי נודות אבל קנקנים לא אמר ליה רב אשי לא שנא נודות ולא שנא קנקנים
13 They at first thought that this applies only to our [vessels used by pagans] but not to theirs. When Rabin came [from Palestine] he said in the name of R. Shimon b. Lakish: [It applies to] either ours or theirs. R. Aha b. Rava thought, sitting before R. Ashi, that this only applies to wineskins but not to earthenware ones. But R. Ashi said to him: It makes no difference whether they be skin-bottles or earthenware ones.
יד ת"ר קנקנים של עובדי כוכבים חדשים גרודים מותרין ישנים ומזופפין אסורין עובד כוכבים נותן לתוכן יין ישראל נותן לתוכן מים עובד כוכבים נותן לתוכן יין ישראל נותן לתוכן ציר ומורייס ואינו חושש
14 Our rabbis taught: Earthenware bottles belonging to pagans, if new and stripped, are permitted, but if old and pitched they are forbidden. If an idolater kept wine in them, the Israelite should put water into them; but though an idolater kept wine in them an Israelite may [immediately] put brine or murias into them without any concern.
